TERMS OF SERVICE

Welcome to D8. These Terms of Service ("Terms") govern your use of the D8 mobile application operated by D8 Night, Inc. ("D8", "we", "us", or "our"). By creating an account or using the app, you agree to these Terms.

1. ELIGIBILITY

You must be at least 18 years old to use D8. By creating an account, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

We reserve the right to request proof of age at any time and to terminate accounts that violate this requirement.

2. YOUR ACCOUNT

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to:

• Provide accurate, current, and complete information during registration
• Keep your account information up to date
• Not create more than one account
• Not transfer or share your account with anyone
• Notify us immediately if you suspect unauthorized access to your account

3. HOW D8 WORKS

D8 is a dating app built around real-world meetups. Key features include:

• 24-Hour Window: When you match with someone, you have a rolling 24-hour window to make plans and meet. After 24 hours, the match expires.
• Vibe Matching: You set your vibe and area preferences before browsing profiles. You are matched with people who want the same kind of night.
• Rain Check: If both users select the same future night, the match is preserved for that date.
• Together Mode: For couples who want to plan date nights together.

4. COMMUNITY GUIDELINES

D8 is a respectful community. You agree not to:

• Harass, bully, stalk, intimidate, or threaten any user
• Post or share content that is sexually explicit, violent, hateful, discriminatory, or illegal
• Impersonate another person or misrepresent your identity
• Use the app for commercial purposes, solicitation, or spam
• Use the app to facilitate prostitution, human trafficking, or exploitation
• Upload photos that you do not have the right to use
• Attempt to circumvent any safety or moderation features
• Use automated systems, bots, or scripts to interact with the app
• Collect or harvest other users' personal information

Violations may result in warnings, temporary suspension, or permanent removal from D8 at our sole discretion.

5. CONTENT YOU PROVIDE

You retain ownership of content you post on D8 (photos, text, voice intros). By posting content, you grant D8 a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content within the app for the purpose of operating the service.

You are solely responsible for the content you post. We reserve the right to remove any content that violates these Terms or our Community Guidelines.

6. REPORTING AND BLOCKING

You can report any user or content that violates these Terms through the in-app reporting tools. You can block any user at any time. Blocked users will not be able to see your profile or contact you.

We review all reports and take action as appropriate, including issuing warnings, suspending accounts, or permanently banning users.

7. SAFETY

While we work to maintain a safe community, D8 does not conduct criminal background checks on users. You are responsible for your own safety when meeting someone in person. We encourage you to:

• Meet in public places
• Tell a friend where you are going (use our "Share Plans" feature)
• Trust your instincts — if something feels off, leave
• Report any unsafe behavior immediately

8. ACCOUNT DELETION

You can delete your account at any time from Settings within the app, or by visiting d8tenight.com/delete-account. When you delete your account:

• Your profile is immediately removed from the app
• Your personal data is permanently deleted within 30 days
• Your messages are removed from all conversations
• This action is permanent and cannot be undone

9. SUBSCRIPTIONS AND PAYMENTS

D8 may offer premium features through in-app purchases or subscriptions. All payments are processed through the App Store or Google Play. Subscription terms, pricing, and renewal details will be clearly displayed before purchase. You can manage or cancel subscriptions through your device's app store settings.

10. INTELLECTUAL PROPERTY

The D8 name, logo, design, and all related branding are the property of D8 Night, Inc. You may not copy, modify, distribute, or create derivative works based on our app or brand without our written permission.

11. DISCLAIMERS

D8 is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the app will be uninterrupted, error-free, or secure. We are not responsible for the actions, content, or behavior of other users.

D8 is not responsible for any outcomes of dates or meetups arranged through the app.

12. LIMITATION OF LIABILITY

To the maximum extent permitted by law, D8 Night, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the app, including but not limited to personal injury, emotional distress, or loss of data.

13. INDEMNIFICATION

You agree to indemnify and hold harmless D8 Night, Inc. and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the app or violation of these Terms.

14. CHANGES TO THESE TERMS

We may update these Terms from time to time. We will notify you of significant changes through the app or by email. Your continued use of D8 after changes are posted constitutes acceptance of the updated Terms.

15. GOVERNING LAW

These Terms are governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions.
